Assume that in 2022 the Minister of the Environment makes the following announcement:“New Zealand has many beautiful coastal areas. Too many of these are being spoilt by tourism ventures that are close to the coastline. The Government intends that legislation will be introduced to limit these and that strict rules will be placed on how many tourism ventures can operate per kilometre of coastline. It is important that no further contracts to sell land in these areas be entered from now on.”Andrew owns coastal land which he is thinking of selling. A major tourism company has expressed an interest and negotiations had been under way. Should Andrew not go ahead with signing a contract before the legislation is passed? Andrew’s friend Brenda is a property developer who thinks the proposed law is too restrictive. She believes it needs exceptions for example where the natural features of the coastline allow a higher number of developments in some areas and a lower number in others. How can Brenda ensure her ideas are considered?Advise both Andrew and Brenda, giving reasons to support your answer. You are not expected to discuss other environmental and planning laws that may apply to tourism and property ventures. The focus of your answer should be on the proposed legislation, whether Andrew’s contact can go ahead, what steps the Minister would need to follow and whether Brenda can stop the proposed law or influence its content.
